TERMS AND CONDITIONS OF SALE

1. General conditions

These conditions apply to all bookings and accommodation agreements concluded between "the Client" and Hôtel Belloy Saint-Germain.

Once a booking is accepted by Hôtel Belloy Saint-Germain, a contract exists between the Client and Hôtel Belloy Saint-Germain; making a booking indicates acceptance of these General Conditions by the Client.

2. Modifications of General Conditions

These General Conditions are subject to change at any time without prior notice. Before making your booking, we recommend that you check the latest ongoing changes on our website.

3. General Conditions and Use of our Website

The use of our website is subject to the General Conditions explained below. By using this website, the Client acknowledges being legally bound by these General Conditions.

All announced discounted rates are limited-time offers, subject to availability, and may be subject to a minimum number of nights. Although every effort has been made to ensure the accuracy of the information presented, Hôtel Belloy Saint Germain accepts no responsibility for any error or omission and reserves the right to amend the information and descriptions of the listed accommodations and its products.

Booking access is limited to the exclusive use of individuals or businesses, excluding any group of rooms constituted for the same stay period. Any group request exceeding 5 rooms must be submitted in writing (email) and is subject to a quote and contract (specific group rates and cancellation conditions).

4. Use of the Website

Use of the websites is limited to persons over 18 years of age, legally competent to enter into a contract.

5. Online Bookings and Third-Party Websites

Please note that different terms and conditions and cancellation policies apply to online bookings made through Booking Agents and other affiliated websites, depending on the city, accommodation, and type of rate selected.

6. Payment Terms and Credit Card Payment Process

Except for the Client who benefits from the "Non-refundable" rate, the Client must pay the full balance at departure or upon arrival using a credit/debit card in their name. They must also comply with verification using the latest chip and PIN technology.

Upon arrival, the Client must also pay a deposit, either by pre-authorization on their card or by cash payment (see below paragraph on deposits).

The Client opting for our "Non-refundable" rate benefits from our best available rates at the time of booking. The full payment is mandatory at the time of booking and is definitely non-refundable.

For security reasons, our "Non-refundable" Client and those who made their booking through a third party and paid in full for their stay must also validate a payment pre-authorization on their credit/debit card and provide valid identification upon arrival.

Hôtel Belloy Saint-Germain accepts major credit and debit cards.

Hôtel Belloy Saint-Germain does not accept checks.

Hôtel Belloy Saint-Germain reserves the right to validate a payment pre-authorization on the credit cards used as a guarantee for bookings corresponding to the amount of the first night of the stay before arrival. Hôtel Belloy Saint-Germain reserves the right to cancel bookings associated with declined or invalid credit cards.

Credit/debit card transactions will be charged at the local exchange rate, and Hôtel Belloy Saint-Germain accepts no responsibility for any additional fees that may be applied.

7. Cancellations and No-shows

According to Article L. 221-28 of the Consumer Code, the client does not benefit from the right of withdrawal provided for in Article L. 221-18 of the same code. The sale conditions specific to the reserved rate specify the terms of cancellation and/or modification of the booking.

The cancellation must be made by email and is only effective upon receipt by the hotel. A written confirmation will be sent to the client. In the absence of this confirmation, the cancellation cannot be considered registered. It is therefore up to the client to ensure that their request has been received.

For all bookings made through a third-party partner, the cancellation must reach the hotel no later than noon (local time), two days before the scheduled arrival date. For any booking made directly on the hotel's website, the cancellation must be received no later than noon (local time), the day before the scheduled arrival date. A cancellation number is provided to the client, which must be retained.

Any cancellation made less than 48 hours before arrival, or the client's absence on the scheduled day, is considered a "no-show." In this case, the total amount of the stay is due and non-refundable.

Bookings with full prepayment ("Non-Refundable") cannot be modified or canceled. The total amount of the stay and any extras is charged at the time of booking and remains acquired by the hotel. Deposits paid are non-refundable in any case.

In the event of an early departure by the client, the full reserved stay will be charged. No refund will be granted, including for prepaid bookings.

The client acknowledges and agrees that the aforementioned cancellation fees constitute a fair and reasonable estimate of the damage suffered by the hotel in the event of cancellation. These provisions are subject to Clause 22 "Dispute and Force Majeure," which defines cases in which neither Party can be held liable for failure to fulfill its obligations, in accordance with Article 1218 of the Civil Code and French case law.

8. Bookings made through Other Channels

Bookings can be made from other sources, including online travel agencies, tour operators, and other websites that apply different cancellation policies. Please refer to your confirmation for more information.

9. Accommodation Changes by Hôtel Belloy Saint-Germain

While all reasonable efforts have been made by Hôtel Belloy Saint-Germain to ensure that bookings made under this agreement are honored, we reserve the right to relocate any booking to similar-sized and standard accommodation in the locality. The Client acknowledges that Hôtel Belloy Saint-Germain accepts no liability for any loss or damage suffered by or caused to the Client following relocation.

10. Changes to the Booking at the Client's Request

If the Client wishes to change their reservation (e.g., change the dates of stay or requested accommodation), Hôtel Belloy Saint-Germain cannot guarantee that it will be possible and accepts no liability for any loss, damage, or additional expenses that may arise in such circumstances.

While modifications are not allowed for the Non-refundable rate, they are permitted for flexible bookings (subject to availability) if the request is made no later than 48 hours before the intended arrival. Additional fees may be applied if the accommodation rate for the new nights differs from that of the previous booking. All requests for changes must be submitted in writing.

11. Identification, Damage Deposits, Extras and Cleaning – Preauthorization on Payment Card

Photo ID will be required upon arrival.

The room accommodations can only host the maximum number of guests indicated in the description, in accordance with legislation concerning Public Access Buildings. No additional visitors are allowed. Upon arrival, the client must provide the hotel with the names of all persons staying with them. Unfortunately, the names of any additional visitors cannot be added after check-in has been completed.

Hôtel Belloy Saint-Germain reserves the right to require a Deposit upon arrival.

A deposit of €50 per night per occupied room is requested in addition to the payment of the stay.

A single payment can be considered, and only the responsible person will assume responsibility for the conduct of the other occupants.

The payment will be used to cover incidental items, including but not limited to, breakage, damage to the residence property, cleaning charges due to the room being left in an unacceptable cleanliness state, and breaches of regulations such as smoking in rooms or disturbing other guests enjoying the hotel. The deposit may also be used by the management team in the event of the presence of additional unauthorized visitors using the hotel and its facilities.

At the end of the stay with no incident, the pre-authorization will be released in accordance with the policy applied by your banking institution. Generally, this takes between 3 and 10 business days, although for some banks this timeframe is extended.

The Client should note that with the pre-authorization system, no money is transferred at the time, but it will affect the available balance and the authorized spending limit with the card as long as the pre-authorization is ongoing. Hôtel Belloy Saint-Germain is not liable for delays related to the release of pre-authorization by credit card companies.

If disturbances to other visitors occur, or in the event of damages to the hotel, the cost incurred to Hôtel Belloy Saint-Germain will be retained from the deposit paid, and only the remaining balance will be returned to the Client.

If this cost exceeds the deposit amount, the Client agrees to indemnify Hôtel Belloy Saint-Germain for damages, additional cleaning expenses, or other costs and agrees to pay all recovery fees including legal fees, and other expenses.

By this means, the Client gives Hôtel Belloy Saint-Germain consent to debit the Client's credit card for all reasonable expenses incurred which are not covered by the deposit.

12. Check-in and Check-out Requirements

The Client must comply with the regulations imposed by Hôtel Belloy Saint-Germain at check-in and check-out times. Unless otherwise agreed in advance, rooms are generally available from 3:00 pm on the day of arrival. In the case of online check-in, the hotel reserves the right to verify the identification of each occupant. In the case of online payment, the client must present the credit card used in their name. The credit card used for payment will be requested by the hotel upon arrival. In case of dispute, the hotel reserves the right to request another payment method or cancel the booking.

To guarantee an early arrival (before 12:00 pm), it is necessary to pre-book the room from the previous night. In the event of a no-show in such circumstances, fees equivalent to two nights will be charged.

Unless otherwise agreed, all rooms must be vacated, and keys returned by 12:00 pm on the day of departure. With prior agreement, late checkouts may be considered on the day of departure. A late checkout incurs additional fees. An additional night will be charged for all checkouts after 3:00 pm.

If the Client does not check-in for their departure formalities by 3:00 pm on the scheduled departure day without prior authorization, Hôtel Belloy Saint-Germain reserves the right to remove the Client's belongings from the room and accepts no liability for any loss or damage to such belongings.

13. Facilities/Services Included in the Price

All rooms are fully furnished and equipped with appliances such as television, minibar, coffee machine, kettle...

Meals and drinks are not included in our product offer unless mentioned in your booking.

No objects/appliances may be removed from the room. The list and prices of objects and services are available at the hotel reception.

All advertised prices include bed linen, towels, access to cable TV, and Wi-Fi Internet. Private use of Wi-Fi is subject to French legislation, security, and IP address recognition. The user is responsible for any actions committed from their access, even if performed by a third party.

The advertised price includes the classic hotel service; it includes VAT at the current rate. Not included is the tourist tax applicable to all persons 18 years and older, which will be collected by the hotel and indicated on the client's invoice.

14. Liability for Damage or Loss of the Client's Property

The Client is solely responsible for choosing Services from the Site and for their suitability for their needs, so Hôtel Belloy Saint-Germain shall not be held responsible in this respect.

The Client is also solely responsible for the information provided when making a Service booking. Hôtel Belloy Saint-Germain shall not be held liable for incorrect or fraudulent information communicated by the Client. Additionally, only the Client is responsible for the use of their account and any booking made, both in their own name and on behalf of third parties, including minors, except in cases of fraudulent use not resulting from any fault or negligence on their part. In this regard, Hôtel Belloy Saint-Germain must be immediately notified of any misuse or fraudulent use of their email address.

The Client undertakes to use the Site and Services offered there in compliance with applicable regulations and these General Conditions. In case of the Client's failure to meet its obligations under these General Conditions, they are responsible for damages caused by them to Hôtel Belloy Saint-Germain or third parties. To this end, the Client undertakes to guarantee Hôtel Belloy Saint-Germain against all claims, actions, or recourse of any kind that may result and to indemnify it for any damages, costs, or indemnities in this respect. Specifically, the Client undertakes, by making a definitive booking of a Service, to pay the price and comply with the related Specific Conditions. In fact:

  • Any booking or payment that is irregular, inoperative, incomplete, or fraudulent for a reason attributable to the Client will result in the cancellation of the Service booking, without prejudice to any action Hôtel Belloy Saint-Germain could take against the latter;

  • The Client must not invite into the Establishment a person whose behavior is likely to prejudice the Establishment;

  • The Client must not bring into the Establishment (rooms and common areas) drinks or food from outside sources unless clearly authorized in advance by the Establishment;

  • Our Establishment is 100% non-smoking; this means that in this situation, it is prohibited to smoke within the Establishment, including in the rooms;

  • The Client must not interfere with the operation of the Establishment and must not compromise the safety of the Establishment or those present;

  • More broadly, any behavior contrary to morality and public order within the Establishment, as well as non-compliance with the Establishment's Internal Regulations, will lead the director of the Establishment and/or any other Service provider to request the Client to leave the premises without any compensation and/or refund if a payment has already been made. If no payment has been made yet, the Client must pay for the Services consumed before leaving the premises;

  • Minors may only stay in an Establishment accompanied by an adult and with personal identification. If the accompanying adult is someone other than the parents, they must be provided with parental authorization from the child's parents. The Establishment may request these elements;

  • The Client also undertakes to ensure that IT resources provided by the Establishment (including the Wi-Fi network) are not used in any way for reproduction, representation, making available, or communication to the public of works or objects protected by copyright or neighboring rights, such as texts, images, photographs, musical works, audiovisual works, software, and video games, without the authorization of the rights holders provided in books I and II of the Intellectual Property Code when such authorization is required. The Client is further obligated to comply with the security policy of the Establishment's internet service provider, including the rules for using security measures implemented to prevent the illegal use of IT resources and to refrain from any act undermining the effectiveness of these measures.

The Client is responsible for all damage caused by them and/or their guests within the Establishment and bears all costs incurred by this damage and/or violation of the aforementioned rules. Hôtel Belloy Saint-Germain reserves the right to intervene if necessary.

15. Liability for Damage or Loss of Property Belonging to Hôtel Belloy Saint-Germain

It is the Client's responsibility to take reasonable care of the room and its contents during their stay at Hôtel Belloy Saint-Germain.

The room and all equipment, utensils, furniture, etc. must be left clean and tidy at the end of your stay; otherwise, charges may apply.

We remind the Client to lock the rooms and close all doors and windows when leaving.

Except in the case of normal wear and tear, you are responsible for any damage to the room or its contents during your stay, which has occurred due to negligence, deliberate misconduct, or irresponsible behavior by you or the occupants of the room or their guests. Any damage must be immediately reported to Management.

16. Use of Hôtel Belloy Saint-Germain and Peaceful Enjoyment of the Premises for All Guests

The Client must undertake nothing in the accommodation that may violate the Law.

The Client must not cause any nuisance to other guests or staff members.

Hôtel Belloy Saint-Germain authorizes the use of its residential units solely for personal use, appropriate and law-abiding.

Hôtel Belloy Saint-Germain expressly prohibits access to its residential units to individuals other than those indicated on the official booking document.

Hôtel Belloy Saint-Germain and the Client agree that no occupancy rights arise from the use of the residence.

The Client is not allowed to rent/sublet the room to a third party.

Hôtel Belloy Saint-Germain reserves the right to deny entry to the hotel and accommodation of a Client if, upon arrival, Management reasonably believes that the person is under the influence of alcohol or drugs, is not appropriately dressed, or is behaving in a threatening, abusive, or otherwise unacceptable manner.

Hôtel Belloy Saint-Germain applies a strict Anti-Party policy. Do not exceed the maximum number of persons per room, and noise levels must not disturb other visitors. Additional fees will be charged to a Client's account if a party is found to have taken place.

The maximum room occupancy is stated on your booking confirmation.

The Client must comply with all reasonable hotel rules and procedures in effect, including but not limited to health and safety procedures and registration requirements.

If during a stay, Hôtel Belloy Saint-Germain receives serious complaints about the Client or if the Client behaves in a manner detrimental to the enjoyment of other clients or their guests, or if the Client violates the General Conditions, then Hôtel Belloy Saint-Germain reserves the right to end the Client's stay without notice and without any obligation to refund any money.

17. Non-Smoking and No Candles Policy

All rooms at Hôtel Belloy Saint-Germain are by law Non-Smoking. A fee of €350 per stay will be charged if you smoke in the room.

The use of candles or open flames in the room is strictly prohibited.

Any act circumventing detection and safety systems may result in prosecution.

18. Access to Rooms by Management

The Management team and its authorized personnel may at any time enter the rooms for the purpose of inspecting the room and conducting repair or maintenance work.

19. Complaints

Hôtel Belloy Saint-Germain guarantees to make every reasonable effort necessary to ensure that the accommodation chosen by the Client is properly furnished and of good quality.

In case of dissatisfaction, the Client must immediately inform Hôtel Belloy Saint-Germain of any complaint, no later than 12 hours after arrival. If Hôtel Belloy Saint-Germain does not comply with its warranty and is unable to correct the problem, Hôtel Belloy Saint-Germain will at its discretion choose to provide you with replacement accommodation (subject to availability) or a partial refund of the amount paid.

The liability of Hôtel Belloy Saint-Germain will in no case exceed the amount paid for the rental period.

20. Child Reception Policy

Children under 3 years old are accommodated free of charge in rooms allowing for a baby bed to be set up.

21. Pets

Small pets are allowed in the rooms for an additional fee of 15 euros per night.

Guide dogs are permitted within the establishment.

22. Disputes and Force Majeure

Neither Party shall be held liable for the total or partial non-performance of its obligations under this Contract if such non-performance results from a force majeure event as defined in Article 1218 of the Civil Code and French case law.

Examples of force majeure events include, but are not limited to:

  • natural disasters such as floods, storms, hurricanes, earthquakes, natural-origin fires;

  • acts of war, attacks, riots, violent social movements, or acts of terrorism;

  • pandemics, epidemics, health crises leading to administrative closure or activity restriction measures for the hotel;

  • decisions or restrictions from competent public authorities, including public access prohibition, curfews, administrative closure, etc.;

  • general and prolonged energy, water, or road access outages, affecting an entire area and not attributable to the Hotel.

In the event of a force majeure event, the Hotel will inform the Client as soon as possible. The Contract will then be suspended for the duration of the force majeure event.

If the impediment is permanent or continues beyond 30 days, each Party may terminate the Contract by right, without compensation on either side, by written notification. Sums already paid by the Client for services not rendered will be credited within a maximum of 60 days from notification, allowing for the reservation of a new event.

In the case of dispute and arbitration, only the Paris Commercial Court will be competent. The General Conditions are governed by French law, without affecting the mandatory protective provisions potentially applicable in the consumer's country of residence.

The Client is informed by Hôtel Belloy Saint-Germain of the possibility of using, in case of dispute concerning these General Conditions, a conventional mediation procedure or any other alternative dispute resolution method, under the conditions provided in Title I of Book VI of the Consumer Code.

After reaching out to customer service or the Establishment to attempt to resolve the dispute amicably, and in the case of a negative response or absence of response within sixty (60) days from the initiation, the Client can refer, at no cost, to the consumption mediator relevant to the professional, namely the Association of European Mediators (AME CONSO).

Hôtel Belloy Saint-Germain also informs the Client of the existence of a European Online Dispute Resolution platform ("ODR") which they can access. The Client can access it from the following link: https://ec.europa.eu/consumers/odr

23. Miscellaneous

In accordance with Article L.223-1 of the Consumer Code, the consumer who does not wish to be subject to telephone canvassing can register for free on a telephone solicitation opposition list. This list is accessible via the following site: www.bloctel.gouv.fr.
